Short too strong: 23-year-old cannot be convicted of reckless driving

In an unusual case with two in the dock and one victim, the judge eventually had to admit that a motorcyclist could not be convicted of reckless driving.

A two-year-old case, in which two motorists stood together in Ørbæk on eastern Funen, has been settled in the district court.

But it had a remarkable outcome. The judge ended up disregarding the prosecution's request for a verdict of reckless driving against one party – a 23-year-old motorcyclist.

Two years ago, the 23-year-old motorcyclist collided with a 56-year-old man in a van, which was stopped in the middle of the road.

It happened because the motorcyclist was speeding too fast. The 56-year-old estimated his speed at around 150 km/h, but this was denied by the motorcyclist, who instead estimated his speed to be 80-100 km/h.

The driver escaped completely. But it was a different matter for the motorcyclist, whom the judge thought he could recognize.

It turned out to be correct. The judge had sentenced the 23-year-old to an unconditional disqualification from the choir card shortly before.

The disqualification was extended to a total of five years, but the judge did not find it proven that it was a case of insanity. Therefore, the motorcyclist gets off with a fine of DKK 5,500.
