Motorist acquitted for driving 192 km/h in 80 zone

According to the high court, it was not possible to prove that a motorist was actually speeding when 'someone' was speeding at 192 km/h in an 80 zone.

According to the Swedish High Court, neither the police nor the prosecution have been able to prove that a driver was driving 192 km/h in an 80-zone.

The case against the man is dropped because pictures from the photo van do not show his face visibly enough. And therefore neither the police, the prosecution nor the judge can say with certainty that the man was behind the wheel.

And since the man at the same time refuses to state who cut the car past the photo van, there is nothing to follow. Not even if the district court previously believed that there was a coincidence with the tattoos that can be seen in the photo from the photo van and the accused's appearance.

But in the high court they were not quite so sure. And from here it seemed that it could not be proved 'beyond any reasonable doubt' that the same man who sat on the dock had also driven past the photo van too quickly.

However, the man did not go completely free. Because the case against him also included a case of violence because he had allegedly kicked another man who was lying down. The court found it likely.

In other cases, it has also happened that the driver has walked free. Even if the offense is obvious at first glance. This happened, for example, to a 40-year-old man who, indeed, blew the police's breathalyzer over the permitted 0.5 per thousand. Read more about it here .
