Motorist must pay DKK 62,000 – Audi was 452 days late

Yngve Paulsen's new Audi was 15 months late. Nevertheless, he must now pay DKK 62,000 to the dealer, the high court has decided.

Yngve Paulsen did not get the Audi Q4 e-tron he had ordered. At least not on time. Nevertheless, he must now pay NOK 62,000 to the car dealer.

The Norwegian High Court has decided that.

The money, which corresponds to just under 40,000 Danish kroner, Yngve Paulsen has to get rid of because of an email. In the email, he accepts that the car will be delayed.

However, he claims that he partially did not know. Instead, Yngve Paulsen says that he was not aware that he had the right to cancel the purchase, as it was clear that the car would never be delivered at the agreed time.

Instead, the city and county court ended as Yngve Paulsen wanted nothing to do with the Audi when it landed after 15 months. The dealer, for his part, would not accept that Yngve Paulsen has now apparently changed his mind.

An agreement was tried to be found in the now-defunct Complaints Board for car cases, but when it was not successful, the case went on to the conciliation council.

In the meantime, it became clear that the car had been delayed so much that it could not be delivered before the Norwegian state levied the tax on the car.

Nevertheless, Yngve Paulsen was sentenced to pay half of a so-called cancellation fee of 50,000 Norwegian kroner. But the case went on to the high court, where everything has gone against Yngve Paulsen.

Here, emphasis was placed on the fact that the car dealer actually gave Yngve Paulsen the opportunity to cancel the car, because it could not be delivered at the agreed price, and that the 15-month waiting period was nevertheless accepted.

– I feel that the court is failing when they come to the conclusion that I accepted the delay. When I replied to the email, I didn't know that I could cancel, he says to norske Motor .
