Woman short 150 km/h – the district court totally acquits her

A mother increased the speed quite considerably – even more than the permitted speed – on the motorway. Nevertheless, the district court has now acquitted her of the speed of 150 km/h.

There won't be much of a punishment for a Swedish mother. Not even if a police officer saw her speeding up to 150 km/h on a stretch of motorway.

The family, who were on their way home from a visit to the grandparents, suddenly found themselves in a precarious situation, where there was an urgent need to find a clean diaper for the daughter in the car.

So behind the wheel, her mother increased the speed to 150 km/h, even though the maximum permitted speed was and is 100 km/h.

In court, the prosecutor otherwise demanded that the woman be sentenced for gross negligence behind the wheel. But the district court chose to ignore that, as the Swedish High Court has said in another case that 189 km/h on the motorway is not grossly negligent in good traffic conditions.

And the district court assessed that there were good traffic conditions when the woman pressed the accelerator. And because the police did not charge her with anything other than carelessness in traffic, nor did they change the subsequent charge, the woman now goes completely free of punishment.

The acquittal also happens because in Sweden – similar to Danish legal practice – you always have to know what exactly you are accused of and therefore have to defend yourself against. There must be no doubt about that.

It is not so rare that mistakes by the police lead to acquittals. Not even if the crime takes place behind the wheel. For example, a man has recently been acquitted, although it is absolutely certain that he drove around with a blood alcohol level greater than the permitted 0.5. Read more about it here .
