Bought 3,300 Fisker Ocean – now the cars are useless

Fisker's agreement on the sale of 3,321 cars to the same leasing company is in jeopardy. All because Fisker has 'forgotten' to move the information about the cars.

The bankrupt Fisker Inc. sold its entire remaining stock of Ocean models in the USA to one and the same leasing company, American Lease. Now the cars are useless.

Otherwise, the plan is for the cars to operate as taxis in New York. But that plan is now in jeopardy because of Fisker Inc. The car brand has not had the information about the many cars transferred to a new server in time.

American Lease needs all the information on the servers for the cars to be used at all. But the bankruptcy estate has not succeeded in moving the amount of data. For the same reason, the leasing company is now threatening to withdraw from the deal.

In any case, the leasing company demands that Fisker's shutdown, which is underway in the American legal system, be prevented.

Right now, the more than 3,300 cars cannot be used, even though Fisker has allegedly received a larger amount in dollars to handle just that sort of thing in connection with the deal. In total, American Lease has paid 320 million Danish kroner for Fisker's residual stock.

– American Lease cannot overestimate the importance of this unwelcome news, which has only come to light after the company has paid Fisker millions of dollars under the purchase agreement, write the leasing company's lawyers.

Therefore, the whole agreement also runs the risk of falling apart. It has otherwise been hoped that the agreement could also benefit the private Fisker Ocean owners in the form of software updates behind a paywall. But now it all hangs in the balance.

– It is currently unclear what the debtor's representatives think about the impossibility of carrying out the transfer of the purchased choir uniforms, and when they became aware of or otherwise knew about the critical information, the lawyers write further.
